Have you had health insurance benefits denial problems, even including workers compensation issues. Join your issues with ours to help us form a national data base for these issues. Together we can unite with our benefits denial issues to be one national voice speaking out against denial practices used by insurers that are abusive, unethical and fraudulent. In repairing a devestating bullet injury to the right hand of our youngest son, (in 8/96 our son was 16), the surgeon made an emergency surgical decision to save our son's hand and not amputate it. After several months our surgeon was not paid according to his fees or to our policy provisions. The insurer would have paid to have our son's hand amputated (100% of the surgeon's fees) but not to have the hand saved/rebuilt (now the same hand has recovered to 50% use). Issues of such benefits denial on valid benefits claims are pervasive in the health insurance industry. The consumer abuse and fraud perpetrated by the Health Insurance Industry as a whole is pervasive and becoming ever the norm as opposed to being rare. Send us your issue either by US Mail or by e-mail. We have NO affiliation with the Health Insurance Industry. We advocate legal equality for policy holders and seek to have legislative reform accomplished that would hold Health Insurers accountable legally for abusive, unethical, and fraudulent benefits denial practices industry wide. We are holding open the options to file a class action lawsuit against the industry as a whole for the following: Violation of the US Mail law, by mailing benefits denials through the US Mail for the purpose of defeating, fraudulently, policy provisions on claims for valid healthcare benefits. For strongarming policy holders into the take it or leave it practice of denial of benefits in part or whole during great times of stress emotionally and financially, during times of illness or injury.(We believe that is a form of blackmail and violates Racketeering/RICO law) We firmly believe that policy holders and their dependents have the same rights under the 14th Amendment to access quality healthcare as a woman has the legal right to access an abortion. The above are the three issues at the top of our beliefs in that the Health Insurance Industry is indeed guilty of consumer fraud perhaps unmatched in the history of this nation. We do not advocate the destruction of the industry, only that they not be held above the law or allowed to hide behind ERISA laws that were created to protect the very policy holders the industry now often abuses and defrauds. If a $10.00 claim is made on every policy held in America this year (approximately 160 million policies of various types), and denied willfully to defeat policy provisions, the health insurance industry has defrauded American consumers/policy holders of a minimum of 1.6 BILLION DOLLARS! How many of us will go to battle with an insurer over $10.00? The insurance industry calculates this type of risk, its called "bean counting". Its an issue that should be exposed to the American public. As well, allowing the ERISA laws to continue to shield insurers violates Americans right to work laws by putting Employers and Employees at odds when a valid conflict over a health insurance benefit occurs that was created by an insurers willfull denial of a valid claim. Insurers must be accountable for their wrongdoings civilly and criminally!
