STATEMENT NO. 2

Statement No. 1 of Helsinki Monitor of Slovenia provoked/attracted great international attention, but on the other hand no attention of the Slovenian media. They obviously estimated that it is not in national interest, in the process of European integration's, to raise dust around such commonplace issues as human rights of non Slovene population in Slovenia. This however does not mean that the government did not pay attention to the Statement of Helsinki Monitor.

It was even a special point on the agenda of the session of the government on February 19. It is interesting that on 20.2.1998 the Ljubljana Delo, dedicated 90% of an article, taking up a quarter of a page, to the report about the Statement No.1 of the session of the government.

What a questionable kind of professionalism it is of the Delo, as well as of other media, which reported about the answer of the minister of Interior, Mr. Bandelj, can be concluded from the fact, that only some newspapers reported on the Statement N.1 of Helsinki Monitor of Slovenia, for example the Maribor Veèer , the Ljubljana Dnevnik, while the Delo published only a short notice, while the other media did not publish anything. The Statement presenting arguments and evidence about the deletion and disappearance of several ten thousands of people of non Slovene ethnic origin in Slovenia , was not published integrally by any media in Slovenia. On the other hand, all important media in other successor states of former Yugoslavia, dedicated enormous space to the Statement No. 1, in accord with its importance for final solution of the position of stateless people in Slovenia, displaced persons and refugees from Slovenia and their citizenship status. It is interesting that the minister of the Interior "severely rejected the complaints of Helsinki Monitor of Slovenia" and designated the data of its representatives on deletion of 130,000 permanent residents of Slovenia on ethnic basis. as "fabricated". In such a way he escaped confrontation with arguments and numbers of the Census 1991, the UNCHR.

Such a furious reaction was followed by other "reactions", continuing from the practice of one-time totalitarian regimes, with only formal, or more or less protocol changes of the social and political structures in Slovenia.

Unknown persons broke into the premises of Helsinki Monitor of Slovenia, breaking the door in the night between 28th to 29th January, after the press conference of Helsinki Monitor held on 27.1.1998. It has been established that the unknown burglers did not steal anything, as if they were the type of burglers intellectuals, who are interested in human rights in a special manner. It has to be taken into account that all this was happening during the period, when Helsinki Monitor was collecting material for the Statement No.1, which was announced on our press conference on 27 January, and which was presented to the media and representatives of embassies on the press conference of 12.2.1998.

At that time Helsinki Monitor had intensive contacts with other Helsinki committees of post Yugoslav states, especially with the Croatian Helsinki Committee. On several occasions CHC sent documentation of a greater number of Croats and Serbs originating from Croatia, who sought their assistance from Slovenia. CHC informed Helsinki Monitor that they asked for a meeting on the highest level in Slovenia through Slovenian embassy in Zagreb, yet they have been rejected with an explanation that the president of Slovenia and the premier do not accept the meeting. Therefore CHC helped Helsinki Monitor of Slovenia to break the blockade of silence of the Slovenian authorities and the media about violations of human rights in Slovenia according to ethnic key, to enable Helsinki Monitor to undertake actions according to its mandate within the International Helsinki Federation.

As a reaction to the Statement No.1 from the state of Slovenia, which is a pretender for membership in the European Union, a visit of a delegation of the EU followed in Ljubljana on Monday, 23rd January, where they met with representatives of Helsinki Monitor in our office - which was also ignored by the Slovene media. Prior to that an event happened, which reminds of the times of totalitarian regimes.

On 20th February, I the undersigned president of Helsinki Monitor of Slovenia Neva Miklavèiè Predan, traveled to Kranj by car around 17 hours. It is important to emphasize that the car was registered a day earlier after a regular technical inspection. The undersigned went to Kranj to a meeting determined by telephone with the previous president of Helsinki Monitor, to set the strategy of the meeting with the delegation of the European Union, among other things.

Half way between Ljubljana and Kranj, close to Medvode, I turned on the heating. In that moment an unusual smell spread, even though there was no smoke. I started to suffocate and lose consciousness, but I succeeded to stop the car by the road, open the windows, shut down the heating, thus trying to drive to Kranj. But the smell reappeared, as well as the symptoms of suffocating and losing consciousness, yet I succeeded to park the car by the road and continue to Kranj hitchhiking. Since I felt bad and was on the verge of fainting, I asked the kind driver to take me to the doctor to the Health Center in Kranj. The doctor there decided that nothing else can be done but to transport me in an ambulance to the Clinical Center in Ljubljana. My health deteriorated, other symptoms appeared, numbness in my fingers and toes, ears, lips, suffocating, rigidity of limbs, dehydration, etc.

After arriving to hospital oversensitivness to odors appeared, temporary high blood pressure, sweating, trembling. I told the doctor that all these conditions are unusual to me, therefore I suppose that it is an attempt of poisoning. I demanded that the police is called, to go to the place where the car was parked, as losing consciousness while driving actually endangered my life.

Around 18.30 a blood sample was taken for the first time, and later on three more times with an explanation, that three times earlier the artery was missed - as if the laboratory assistants do not know their job. The blood sample was taken last at 22.30, as stated on a medical document, ie. 4 hours after arrival to the Ljubljana hospital. I was taken there because of poisoning demanding urgent medical intervention. In the document, the photocopy of which I have, it can be seen that only analysis of CO, carbon monoxide, was performed, and that it is normal., while I demanded analyses of a wider range of poison from dr. Jazbec, the toxicologist. Around 20.30 a criminalist came to the hospital, who started to explain to me in the presence of the medical personnel , and my husband, that I am "overworked", because I am the kind of a person who works day and night (how does he know that?), and that I need rest, that I am obviously frightened because of the burglary into the office of Helsinki Monitor, and that I should dedicate my time to my family.

My husband and my son who in the meantime were already in the hospital, noticed a swift change in the attitude to my health problem after the visit of the criminalist. The medical personnel, who talked on the corridor that the president of Helsinki Monitor arrived to the department poisoned, at once changed their opinion and commentaries.

The result was a medical diagnosis of the toxicologist dr. Jazbec and nephrologist dr. Kovaè on around at 10 o'clock a.m. of the following day of possible paranoid psychosis in my case. Therefore they wanted to transfer me to psychiatric clinic at once. Dr. Jazbec reached such a conclusion without seeing my health file and without a consultation with my doctor, general practitioner, after only 10 minutes conversation with me upon arrival to the Department of Poisoning the previous evening. I refused the demand of dr. Jazbec and demanded indications for such a treatment, after I have peacefully slept in the hospital through the night from Friday to Saturday. I demanded the final toxicological diagnosis and explained to the doctor, that I have to go home to get ready for the meeting with the delegation of the European Union.

After that Dr. Jazbec was even more energetic with her demand that I have to go to the psychiatrist first or else she will not let me go out of hospital. I warned her, that was an illegal act of detention. For five hours during the morning and the afternoon the nephrological - toxicological combination Kovaè-Jazbec tried to force me, on the basis of their unexplained ocular observation, to remain in hospital, ie on a psychiatric department. Only around 3 p.m. on Saturday, 21st February, after a telephone conversation with my legal representative and a colleague from Helsinki committee, I succeeded to win permission to leave hospital, and a temporary letter of dismiss ion, which states that I was admitted to hospital to test carbon monoxide and nothing else. Together with such a diagnosis dr. Jazbec enclosed a reception order for psychiatrist because of eventual paranoid psychosis due to attempt at my life.

On 24.2.1998 I visited the head of the intoxication department to express my protest about the treatment by dr. Jazbec, and to get main letter of dismiss ion with toxicologic diagnosis, which I did not receive. The only thing which I did get from the head, was his explanation that I should understand his position.

On Monday, 23rd February I have informed our members present at the meeting about the events on 20th and 21st February on the way to Kranj and in hospital, and after that the representatives of Helsinki Monitor had a long conversation with the visitors from the European Union.

As a reply to the described attempt of discreditation of the undersigned president of Helsinki Monitor of Slovenia, and with that indirectly also discreditation of reports and statements of our national Helsinki committee, we appeal to the the Chamber of Medical Doctors to investigate this case of obvious misuse of medicine and medical ethics. We appeal to the parliamentary and state institutions to introduce an investigation and answer to numerous dilemmas originating from the burglary into the office of Helsinki Monitor of Slovenia, as well as from an attempt of misuse of medicine, and the work of the criminalist service.

I, the undersigned president of Helsinki Monitor declare my readiness to submit myself to psychiatric analysis of any clinic of European states practicing principles of medicine and not political medicine of totalitarian regimes, which is obviously being practiced even today by some of their mental successors in Slovenia.

Till today the medical documentation , the results of tests has been expected, yet instead of that a bill for the above described medical services arrived, because someone has up to date established a delay of 4 days in confirmation of my health insurance.

As far as the criminalist investigation of my car is concerned - for an unexplained reason the criminalists started it the next day at 8.30 a.m. and they did not find anything. Yet it has been stated by one of them that it is difficult to find anything in intoxication's with volatile substances after some time has passed. The case was transferred to the public prosecutor according to official duty.

Helsinki Monitor of Slovenia will inform international institutions via the network of International Helsinki Federation and OSCE, through embassies in Ljubljana and Vienna, and foreign press agencies. This is the best way for the international institutions to convince themselves of what can happen in one of the states in transition, which is full of stories of democracy and human rights, while the authorities, the media and the opposition are silent together about actual problems, in the interest of "national" or better nationalistic interest, thus transforming its citizens into hostages of a new collectivism.
